Photography Terms of Service

This document outlines the terms and conditions for photography services provided by Micaela Sling Photography (Zamaluwa Digital Group). By booking photography & videography services, the client agrees to the following terms:

1. Payment Terms

1.1 A non-refundable deposit or retainer fee of 50% is required to secure the booking. The remaining balance is due the day of the scheduled session date.
1.2 Payments can be made via direct deposit into the business account (expenses on client account), PayGenius (credit or debit card) payment link with a 5% of the quote amount charge, PayPal with a 7% of the quote amount charge or cash with a R50 charge (only 50% can be paid the day of the photoshoot, the other is required before shoot).
1.3 Failure to complete the payment within the specified timeframe may result in cancellation of the booking, and the deposit will be forfeited.

2. Booking Terms

2.1 Bookings are confirmed only upon receipt of the deposit.
2.2 The agreed-upon date and time are reserved exclusively for the client.

3. Cancellation Policy

3.1 Cancellations must be made in writing at least 4 days before the scheduled session, 50% non-refundable deposit will be required if slot was booked and secured.
3.2 If the client cancels on the day of the session, 100% of the agreed-upon fee will be charged as a cancellation fee.
3.3 Rescheduling is permitted with at least 3 days' notice. A new date will be mutually agreed upon, subject to availability. If late booking, rescheduling can be done within 24 hours, subject to availability.

4. Rescheduling Policy

4.1 Clients may reschedule their session once without additional charges, provided at least 3 days' notice is given.
4.2 Subsequent rescheduling or short-notice changes may incur an administrative fee of 30% of quote value at the discretion of the business to forfeit penalty.

5. No-Show Policy

5.1 If the client fails to show up for the session without prior notice (of minimum 3 hours), the full session fee will be forfeited.
5.2 No refunds will be issued, and a new booking will require a new deposit and full payment.

6. Forfeiture of Deposit and Full Payment

6.1 The deposit is non-refundable under all circumstances, including cancellation, rescheduling beyond allowed limits, or no-shows.
6.2 If the client fails to comply with payment terms, cancellation, or rescheduling policies, the full payment may be retained at the photographer's discretion.

7. Force Majeure

In the event of unforeseen circumstances such as extreme weather, illness, or other emergencies beyond control, either party may reschedule the session without penalty.

8. Client Responsibility

8.1 The client is responsible for arriving on time and being prepared for the session.
8.2 Delays caused by the client may result in reduced session time or additional fees (pro-rata of the quote), depending on availability.

9. Photographer’s Right to Cancel

9.1 The photographer reserves the right to cancel the session for any reason, with prior notice. However, the photographer will try and assist the client and find a replacement photographer.

10. Photography Policy Statement: RAW/Unedited Images

As part of my photography services, I provide only the final edited images to my clients with a post production of up to 2 weeks - unless escalated rate paid. RAW files and unedited images are not included in the standard deliverables. If you wish to receive RAW/unedited images, this can be discussed and arranged in advance, subject to an additional fee as well as choice of photographer. Please contact me prior to your session if you are interested in this option to discuss further.

Agreement

By booking a session with Micaela Sling Photography (Zamaluwa Digital Group), the client acknowledges and agrees to all the terms and conditions outlined in this document.
