Photographs publicly used for marketing and advertising purposes unless requested not to used. Images will be downloadable and stored for up to 3 months (unless chosen to remain longer on server). 

Photography Privacy Policy and Usage Rights

This Privacy Policy outlines how Micaela Sling Photography (Zamaluwa Digital Group) handles client data, image usage, and copyright conditions for photography services. By booking with Micaela Sling Photography (Zamaluwa Digital Group), the client agrees to the following terms:

1. Privacy and Data Protection

1.1 Micaela Sling Photography (Zamaluwa Digital Group) values your privacy and will only collect, store, and use personal information (e.g., name, contact details, and addresses) for purposes directly related to providing photography services.
1.2 Personal information will not be shared with third parties unless required by law or with explicit client consent.
1.3 Images captured during the session may be stored securely for a reasonable duration to allow for editing, delivery, and backup purposes (edited images (jpeg) up to 3 months).

2. Marketing and Public Posting

2.1 Micaela Sling Photography (Zamaluwa Digital Group) reserves the right to use selected images from your session for marketing purposes, including but not limited to:

  • Website portfolios

  • Social media platforms (e.g., Instagram, Facebook, etc.)

  • Online or print advertising

  • Photography competitions
    2.2 Images used for marketing will not include personally identifiable information without explicit client consent.
    2.3 Clients who prefer their images not to be used for marketing purposes must notify Micaela Sling Photography (Zamaluwa Digital Group) in writing before the session or at the time of booking.

3. Usage Rights and Copyrights

3.1 All images created during the session remain the intellectual property of Micaela Sling Photography (Zamaluwa Digital Group). The photographer, Micaela Peters, retains full copyright ownership of all photographs.
3.2 Upon full payment, the client receives a license for personal use of the delivered images. This license allows:

  • Sharing on personal social media accounts (with appropriate credit to Micaela Sling Photography (Zamaluwa Digital Group), if required).

  • Printing for personal use.
    3.3 The license does not permit:

  • Altering the photographs without consent (e.g., applying filters or cropping significantly).

  • Selling, sub-licensing, or commercial use of the photographs without prior written agreement.

4. Client-Specific Agreements

4.1 Commercial clients will receive tailored agreements regarding usage rights and licensing based on the project scope.
4.2 Requests for extended usage rights or exclusive copyrights must be negotiated separately, with additional fees applicable.

5. Rights to Decline Usage

5.1 Micaela Sling Photography (Zamaluwa Digital Group) reserves the right to decline any use of photographs that may misrepresent the business or damage its reputation.
5.2 If images are used without permission in violation of the usage agreement, Micaela Sling Photography (Zamaluwa Digital Group) may take legal action to protect its intellectual property.

6. Image Retention and Archiving

6.1 Final edited images will be archived for [duration, e.g., 1 year] after delivery. Archival copies may be available for re-download at the photographer’s discretion and may incur an administrative fee.

By engaging with Micaela Sling Photography (Zamaluwa Digital Group), the client acknowledges and accepts this privacy policy, the usage rights, and copyright terms outlined above.
